Flights, prices and fees are subject to change without notice. Cancellations less than 24 hours in advance, and no shows are subject to 100% cancellation fee. Guests over 275 lbs. may be charged an additional seat. Delta Seaplanes is a Federal Aviation Administration Certifies Part 135 On Demand Carrier. All flights are non-scheduled and are subject to cancellation due to poor weather or low demand. Fuel surcharges may apply.

Delta Seaplane Tours (DST) is the seller of all seaplane tours in the Bay Area and other ancillary items, including but not limited to certificates, photographs, videos, merchandise, food and beverages. All dealings with DST will be on these Terms of Trade (Terms) unless otherwise agreed in writing with DST.

1. The Tour

DST reserves the right to add, withdraw, substitute and/or vary advertised routes, prices and departure times for the tour or Gift Certificate without notice. However, reasonable effort will be made to maintain arrangements as advertised.

2. Check-in for the Tour

All passengers of DST are required to arrive and check-in at the prearranged check-in destination (usually Sacramento Jet Center) at least 15 minutes prior to the scheduled departure time. Arrival after this time may result in cancellation of the Tour at DST's discretion, without refund.

3. Requirements to participate in the Tour

All passengers must hold a valid ticket, gift certificate or confirmation letter. Entry may be refused if tickets or vouchers are damaged or defaced in any way or not purchased from an authorized point of sale. Should a dispute arise over the validity or voucher DST reserves the right to refuse participation in the Tour unless the passenger is able to show proof of their identity.

Passengers must be 12 years of age and over, be of sound mind and be in good health. Adult supervision of minors is required.

All passengers enter DST's premises and participate in the Tour at their own risk.

4. DST's discretion to refuse participation

DST reserves the right to refuse any person, for whatever reason, from participating in the Tour, in its absolute discretion, whether or not they have previously purchased a ticket.

5. During the Tour

Passengers must obey the directions and instructions of DST's pilots, and must not disturb other passengers or interfere with the pilot's ability to conduct the Tour.

6. Miscellaneous Terms

No smoking is permitted on DST's aircraft.

All pagers and mobile phones must be turned off once the Tour begins.

DST reserves the right to inspect any bag or container brought onto DST's premises.

7. Terms of payment

DST's gift certificates are transferable. Tours and Gift Certificates must not be offered as prizes, offered for sale or resale, or resold or used for any commercial purpose, including without limitation promotion of any supplier or any supplier's products or services, without DST's prior permission.

Bookings can only be changed up to 7 days prior to the original Tour. DST reserves the right to charge a booking fee on the purchase of tickets and an administration fee should tickets purchased be changed to another date or time.

All Tours must be paid for at the time of booking unless otherwise agreed by DST in advance, and then only after filling out a credit application form. Payment for credit sales must be made 14 days from date of invoice. DST reserves the right to cancel tickets purchased in advance which are not paid for.

8. Cancellation and refunds

Tours will not proceed should DST decide that the weather makes the participation in a Tour unsafe, or for any other reason, at the absolute discretion of DST. Should a Tour not proceed then passenger(s) will either be re-booked at the earliest possible time, at the convenience of the passenger(s) and taking into account available places; be issued a refund voucher, in the case of purchases bought through an agent; or be reimbursed the price paid for the ticket. The relevant party who has sold the ticket to the passenger will make all reimbursements.

There will be no refund of a ticket by DST except in accordance with these terms or as agreed in writing by DST. Refunds will only be made to the person who purchased the ticket from DST.

9. DST's liability

To the extent permitted by law, DST excludes liability and will not be responsible for any loss, damage or injury arising from or connected with the Tour, no matter how that loss, damage or injury is caused. In particular, DST will not be responsible for loss or damage arising from a passenger(s) failure to obey DST's instructions. Further, but only to the extent permitted by law, DST will not be responsible for loss or damage arising from any negligent act or omission of DST or any person for whom DST is responsible. Certain laws imply non-excludable conditions and warranties. This provision does not exclude those conditions and warranties but limits DST's liability in relation to these to provision of services provided by DST.

Further, DST is not liable for any loss, damage or inconvenience arising from or incidental to any delay in a scheduled Tour taking place.

10. Gift Certificates

Terms applicable to the sale of Gift Certificates:

Gift Certificates will be sold either for a specific Tour, or for a specific amount. Gift Certificates are non-refundable but transferable. Gift Certificates must not be offered as prizes or resold or used for any commercial purpose, including promotion of any supplier or any supplier's products or services, without DST's prior written permission.

DST reserves the right to discontinue the sale of any item purchased on a Gift Certificate, but agrees to replace the item discontinued with any other item of equal value.

A Gift Certificate must be redeemed within 12 months from date of purchase and the Tour must take place within the 12 months.

11. Governing Law

These terms are governed by the laws of California and Nevada. DST and each passenger are subject to the jurisdiction of the Courts of California and Nevada, with respect of these Terms and any dispute between them.

All Gift Certificates are valid for twelve months.
